Information notice — location tracking during rounds

Why this document

You are going to use the EatTrack Driver app as part of your work. During your rounds, this app records your vehicle's location.

This document explains what is recorded, when, why, who can see it and for how long. There is nothing for you to agree to: this is information, not a request for permission.

Who is responsible

Your employer — the vendor you drive for — decides how this app is used and what happens to the data it produces. Their name and contact details appear in the notice shown when the app first opens, which is the authoritative version.

The app is provided by NYOS SRL (Rue André Mathys 18, 1350 Orp-Jauche, company number 0647.925.059), which hosts it and keeps it running on your employer's behalf.

What is recorded

Your identity

Your name and email address, entered by your employer when creating your access. Your password, which you set yourself, is never visible to your employer or to NYOS.

The vehicle's location

Only while you are online. Location is recorded every 15 seconds, or every 20 meters traveled.

You decide when this starts and stops: recording begins when you tap "Go online" and stops when you tap "Go offline". The app never starts recording on its own.

While you are online, location continues to be recorded even when the app is not on screen — this is necessary for customers to see you on the map while you drive. Your phone shows this at all times: a blue bar at the top of the screen on iPhone, a notification on Android.

Your round activity

The time you go online and offline, for each round. And a record of which rounds were assigned to you, and on which dates.

What is not recorded

The app does not record your location outside the periods when you are online. It cannot track you in the evening, at weekends, or during your breaks if you have gone offline.

It does not record your personal journeys, your contacts, your communications, or any data from your phone other than its location while on duty.

Why this data is recorded

Location allows customers to see where the vehicle is in real time and to be notified when it passes by. That is the purpose of the service.

Start and end times allow your employer to know whether rounds are running as planned.

This processing relies on your employer's legitimate interest in organizing and monitoring their commercial activity. It is not used to assess your individual conduct outside that scope.

Who can see what

Your employer sees the vehicle's location in real time during your rounds, along with the history of locations and of your start and end times.

Customers using the public app see the vehicle's location while you are online. As soon as you go offline, the vehicle disappears from their map. Your name is never disclosed to them: they see a business and a vehicle, not a person.

NYOS, as technical provider, may access the data where necessary to operate or repair the service.

No one else. This data is neither sold nor passed on to third parties.

For how long

Recorded locations are automatically erased after fourteen days. This erasure is automatic and permanent.

Round start and end times, along with the record of rounds assigned to you, are kept without time limit: they form the company's activity history.

Your account is kept as long as you work for the company. If it is deactivated, you can no longer sign in, but your history remains.

Your rights

You have the right to access your data, to have it corrected if inaccurate, to have it erased, to restrict its processing and to object to it, as well as the right to data portability.

The app has no screen allowing you to view or correct your data directly. Send your request to your employer, using the details at the top of this document. They will respond within one month.

If you believe your rights are not being respected, you may lodge a complaint with the Belgian Data Protection Authority (www.dataprotectionauthority.be, Rue de la Presse 35, 1000 Brussels).

One important point

This app only works if you go online. If you don't, customers cannot see you, and your employer does not know the round has started.

So it is up to you to remember at departure. Nothing does it for you.
